Firearm & Ammunition Transfer, Storage, and Non-Pickup Policy

This Firearm & Ammunition Transfer, Storage, and Non-Pickup Policy explains the storage terms, customer responsibilities, and non-pickup procedures that apply when TacticCAL Gun Store / FFL Dealer Sunnyvale receives a firearm or ammunition shipment on behalf of a customer.

1. Notification and Start of Transfer Period

Upon receipt of a firearm or ammunition package, TacticCAL Gun Store / FFL Dealer Sunnyvale will notify the customer by email using the contact information provided by the customer.

The thirty (30) calendar day transfer period begins when both of the following have occurred:

  • The firearm or ammunition has been delivered to the FFL location; and
  • The customer has been notified by email to schedule the customer’s first transfer appointment.

2. Standard Transfer Window

Customers have thirty (30) calendar days from the notification date to complete all required transfer steps, including any required background check, DROS process, paperwork, waiting period, and pickup.

No storage fee will be charged during the initial thirty (30) calendar day period, unless a separate written agreement states otherwise.

3. Storage Fees After 30 Calendar Days

If the customer does not complete the transfer and pick up the firearm or ammunition within thirty (30) calendar days after notification, storage fees will begin accruing as follows:

  • Days 31 through 40: $3.00 per day, per firearm or per ammunition package.
  • Day 41 and each day thereafter: $5.00 per day, per firearm or per ammunition package.

Storage fees continue to accrue until the firearm or ammunition is lawfully transferred, picked up, returned, or otherwise handled in accordance with applicable law.

4. Customer Responsibility for Fees

The customer is responsible for all accrued storage fees and any reasonable administrative costs resulting from delayed pickup, failed transfer completion, non-response, return shipment, lawful disposition, or other handling required because the customer failed to complete the transfer in a timely manner.

All accrued fees must be paid before the firearm or ammunition is released, unless management approves a different written arrangement.

5. Special Arrangements

Customers who need additional time must contact TacticCAL Gun Store / FFL Dealer Sunnyvale before the expiration of the initial thirty (30) calendar day period.

Any extension, waiver, reduction, or modification of storage fees must be approved by store management in writing. Verbal statements do not modify this policy.

6. Failure to Complete Transfer or Pick Up Property

If the customer fails to complete the transfer, fails to pick up the firearm or ammunition, or fails to respond to reasonable contact attempts, TacticCAL Gun Store / FFL Dealer Sunnyvale may take reasonable administrative action, including but not limited to:

  • Continuing to store the firearm or ammunition while storage fees accrue;
  • Contacting the customer using the information on file;
  • Returning the firearm or ammunition to the original transferor or sender, where lawful and practical;
  • Recovering unpaid storage fees, administrative costs, return shipping costs, or related expenses through lawful means; or
  • Taking other action permitted by applicable federal, state, and local law.

7. No Automatic Transfer of Ownership

Firearms and ammunition will not automatically become the property of TacticCAL Gun Store / FFL Dealer Sunnyvale merely because storage fees have accrued or because the customer has failed to pick up the item.

Any transfer, return, sale, disposal, or other handling of an unclaimed firearm or ammunition item will be performed only in a manner consistent with applicable federal, California, and local law.

8. Electronic Acknowledgment

As part of the pre-intake or appointment process, customers may be required to electronically acknowledge this policy before TacticCAL Gun Store / FFL Dealer Sunnyvale accepts or processes a transfer.

By checking the policy acknowledgment box, submitting the pre-intake form, or otherwise electronically agreeing to this policy, the customer confirms that the customer has read, understands, and agrees to be bound by this policy, including the storage fee terms and non-pickup procedures.

9. Policy Versioning and Recordkeeping

TacticCAL Gun Store / FFL Dealer Sunnyvale may update this policy from time to time. Each version will include a version number and effective date.

For recordkeeping and customer-consent purposes, TacticCAL Gun Store / FFL Dealer Sunnyvale may retain records showing the policy version accepted by the customer, date and time of acknowledgment, customer name, customer email address, IP address, order number, appointment record, or other related intake information.

10. Customer Acknowledgment Language

The following acknowledgment may be used during online pre-intake, checkout, appointment scheduling, or transfer intake:

I have read and agree to be bound by the Firearm & Ammunition Transfer, Storage, and Non-Pickup Policy, including all applicable storage fees and terms for delayed pickup, non-response, return, or lawful disposition. By checking this box, I acknowledge that this constitutes my electronic signature and agreement under applicable law.

11. Management Discretion

Store management may approve exceptions or special arrangements in writing. Any exception must be documented and does not waive the right to enforce this policy in other cases.

12. Legal Compliance

This policy is intended to operate in compliance with applicable federal, California, and local laws governing firearms, ammunition, transfers, storage, recordkeeping, and disposition. If any portion of this policy is found to be invalid or unenforceable, the remaining provisions will continue to apply to the fullest extent permitted by law.
