California’s gun laws are dense, fast-changing, and frequently misunderstood. Here’s a 2026 overview for Bay Area residents — Sunnyvale, San Jose, Santa Clara, Mountain View, Palo Alto, Cupertino, Fremont, Oakland, Berkeley, Hayward, Milpitas, Campbell, Los Gatos, Saratoga — covering the laws most likely to affect a typical purchase.
Handgun rules
CA DOJ Roster. Semi-automatic handguns must be on the Roster of Handguns Certified for Sale to be legally sold by an FFL dealer. The Roster is updated periodically; some popular models have come off the list while others remain on it.
PC 32100 exemption. Single-action revolvers meeting four criteria (single-action, 3+ inch barrel, 7.5+ inch overall length, 5+ round capacity) are exempt from the Roster.
10-day waiting period. Required for every firearm purchase, regardless of buyer history.
Firearm Safety Certificate. Required to take possession of any firearm. Available at TacticCAL, valid 5 years.
Background check via DROS. $37.19, processed by the CA DOJ.
One-handgun-per-30-days. Most buyers cannot purchase more than one handgun in any 30-day period.
Long gun rules
Assault weapon definition. California defines “assault weapons” with a feature-based test. A semi-automatic centerfire rifle with a detachable magazine and any one “evil feature” (pistol grip, telescoping stock, flash hider, forward grip, etc.) qualifies — and is illegal to manufacture, sell, or transfer in California.
Two compliant configurations. Featureless (no evil features but detachable mag allowed) or fixed magazine (mag locked in place but features OK). Both are legal.
10-round magazine limit. Magazines holding more than 10 rounds are prohibited from sale, manufacture, or import. Pre-2000 owner rules face complex grandfather-clause litigation.
Ammunition rules
Background check for ammo. California requires every ammunition purchase to go through a background check. $5 for standard, $19 for first-time or expired.
Internet ammunition shipping. Online ammunition orders cannot ship directly to your home in California. They must ship to a licensed vendor, who runs the background check at pickup.
Caliber-restricted purchases. Some calibers (e.g., .50 BMG) face additional restrictions in California.
Other 2026 considerations
CCW (Concealed Carry Weapon). Following recent court rulings, California issues CCW permits via local sheriff or police chief. Requirements vary by county. Santa Clara County has its own application process.
Universal background checks. All transfers between private individuals must go through an FFL.
Transport rules. Long guns can be transported in a vehicle if unloaded. Handguns must be unloaded and in a locked container, separate from ammunition (with limited exceptions).
Storage requirements. California has child access prevention laws. Firearms must be securely stored when not in use.
Red flag laws. California has gun violence restraining orders (GVROs) that allow temporary firearm removal from individuals deemed an imminent risk.
Bay Area-specific notes
While most California gun law is set at the state level, some local jurisdictions have additional rules:
- San Francisco has stricter ammunition reporting requirements
- Oakland has additional dealer requirements
- Most Santa Clara County cities (Sunnyvale, San Jose, Santa Clara, Mountain View, Palo Alto, Cupertino, Saratoga, Los Gatos, Campbell, Milpitas) follow state-level rules without major additions
